Terms of Use (ToU)

1. Purpose

These Terms of Use (hereinafter "ToU") define the conditions for accessing and using the website FlowMarket(hereinafter "the Site" or "the Platform"), published by Flowmarket.

Registering and using the Site implies full and unreserved acceptance of these ToU. If you do not accept these terms, please do not use the Site.

2. Service Description

FlowMarket is an intermediary marketplace platform that enables:

• The buying and selling of automation workflows (in particular n8n)
• Connecting workflow creators with clients
• Requesting configuration, installation, or custom development services

FlowMarket acts as a technical intermediary and is not a party to transactions between buyers and sellers. FlowMarket does not create, guarantee, or bear responsibility for the quality, legality, or compliance of workflows sold by creators.

3. Registration and User Account

Certain features of the Site require the creation of a user account. By registering, you agree to:

• Provide accurate, complete, and up-to-date information
• Maintain the confidentiality of your login credentials
• Be solely responsible for all activity conducted through your account
• Notify us immediately of any unauthorized use

You must be at least 18 years old or have the authorization of your legal guardian to use the Site.

4. Platform's Role as Intermediary

FlowMarket acts as a host and technical intermediary within the meaning of the French Law for Confidence in the Digital Economy (LCEN). As such:

• FlowMarket facilitates the connection between buyers and sellers
• FlowMarket is not a party to contracts concluded between users
• FlowMarket does not exercise any prior editorial control over content published by sellers
• FlowMarket undertakes to remove any content reported as unlawful as quickly as possible

5. User Obligations

By using the Site, you agree to:

• Comply with applicable laws and regulations
• Not infringe third-party rights (intellectual property, privacy, etc.)
• Use the Site in good faith and in accordance with its intended purpose
• Only publish content to which you hold the rights

6. Prohibited Behaviours

The following are strictly prohibited:

• Fraud: using false information, impersonating another user, manipulating reviews or ratings
• Spam: sending unsolicited messages, publishing unauthorized promotional content, or abusing the messaging system
• Payment circumvention: attempting to conduct transactions outside the Platform to avoid commissions, sharing direct payment details
• Illegal content: publishing workflows containing malicious code, pirated software, or any content contrary to public order
• Technical attacks: attempting to compromise the security of the Site, conducting denial-of-service attacks, or mass-scraping content
• Unauthorized resale: reselling or redistributing purchased workflows without the creator's authorization

7. Moderation and Suspension

FlowMarket reserves the right, without prior notice or compensation, to:

• Temporarily or permanently suspend or delete a user account in case of violation of these ToU
• Remove any content contrary to these ToU or applicable law
• Block access to the Site in case of abusive or fraudulent behaviour

The user will be informed by email of the reasons for the suspension or deletion of their account, except in cases of emergency or legal obligation.

8. Intellectual Property

The Platform and all its elements (design, code, logos, texts) are the exclusive property of Flowmarket. Published workflows remain the intellectual property of their respective creators.

By publishing a workflow on FlowMarket, the seller grants FlowMarket a non-exclusive, worldwide, royalty-free licence to display, promote, and distribute said workflow on the Platform.

9. Service Availability

FlowMarket endeavours to ensure continuous availability of the Site. However, FlowMarket does not guarantee uninterrupted access and reserves the right to temporarily suspend access to the Site for maintenance, updates, or force majeure reasons.

10. Links to Third-Party Sites

The Site may contain links to third-party websites. FlowMarket exercises no control over these sites and accepts no responsibility for their content or practices.

11. Amendments to the ToU

FlowMarket reserves the right to amend these ToU at any time. Users will be informed of any material change by email or notification on the Site. Continued use of the Site after an amendment constitutes acceptance of the updated ToU.

If you disagree with the updated ToU, you must stop using the Site and delete your account.

12. Personal Data, Retention, and Deletion

Personal data processing is detailed in the privacy policy. FlowMarket applies a limited retention principle: data is retained for as long as necessary to operate the service, then deleted, anonymised, or retained only where legal, contractual, accounting, or evidentiary obligations require it.

When a user requests account deletion, access is disabled immediately, the seller's listings are unpublished, and final account-data anonymisation takes place within 90 days maximum after the validated request, subject to legal obligations and any still-active transactions or services.

In accordance with the storage limitation principle, an account with no activity for 2 years may be automatically anonymised, except where retention remains necessary to comply with a legal obligation, manage a transaction or active service, or defend our rights.

13. Governing Law and Jurisdiction

These ToU are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution before taking legal action. Failing that, jurisdiction is attributed to the competent French courts.

For disputes with a consumer residing in the European Union, you may use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr.

14. FlowMarket Pro Subscription
