Limitation of Liability

1. Platform Role

FlowMarket is an intermediary platform that facilitates connections between automation workflow creators and buyers. FlowMarket is not the publisher or creator of the workflows sold on the Platform and does not control their quality, functioning, or compliance.

2. No Guarantee of Results

FlowMarket guarantees no results arising from the use of purchased workflows or services performed by creators. In particular:

  • No guarantee that workflows will produce the results expected by the buyer
  • No guarantee of compatibility with the buyer's specific technical environment (n8n version, connected third-party services, network configuration, etc.)
  • No guarantee of permanent availability of third-party services used by the workflows (APIs, connected platforms)
  • No guarantee that the workflow will remain functional after an update to n8n or connected services

3. Exclusion of Liability

To the extent permitted by law, FlowMarket shall under no circumstances be held liable for:

3.1 Financial Losses

  • Loss of revenue, profit, customers, or business opportunities
  • Cost of replacement goods or services
  • Losses arising from a business interruption caused by a workflow

3.2 Automation Errors

  • Erroneous, mass, or unauthorised email sends caused by a misconfigured workflow
  • Deletion, modification, or corruption of data caused by workflow execution
  • Unwanted interactions with third-party services (APIs, CRMs, social networks, etc.)
  • Infinite loops, resource overconsumption, or system overload

3.3 Misuse

  • Use of a workflow for purposes not intended by the creator
  • Modification of a workflow by the buyer resulting in a malfunction
  • Use of a workflow in violation of applicable regulations (GDPR, consumer law, etc.)
  • Failure to meet the technical prerequisites stated in the workflow description

3.4 Data Loss

  • Loss, alteration, or leakage of data resulting from the use of a workflow
  • Personal data breach caused by a poorly secured workflow

3.5 Disputes Between Users

  • Disputes between buyers and sellers regarding the quality, conformity, or functioning of a workflow
  • Disputes relating to personalised service contracts

4. User Responsibility

Each user is solely responsible for:

  • Verifying that a workflow meets their needs before purchasing
  • Testing a workflow in a test environment before deploying it to production
  • Backing up their data before executing a workflow
  • Complying with the terms of use of third-party services connected to the workflows
  • Ensuring their use of workflows complies with applicable regulations

5. Recommendations

Before using a purchased workflow, we strongly recommend:

  • Testing in a development environment before any production deployment
  • Backing up your data before running any new workflow
  • Reading the documentation and workflow prerequisites carefully
  • Checking the permissions granted to connected third-party services
  • Contacting the creator if you are unsure about the configuration

6. Force Majeure

FlowMarket shall not be held liable for any failure to perform its obligations resulting from a force majeure event as defined by Article 1218 of the French Civil Code, including in particular: natural disaster, pandemic, network outage, cyberattack, government decision, or any other circumstance beyond FlowMarket's reasonable control.

7. Liability Cap

In all cases, FlowMarket's total liability, for all causes combined, is limited to the total amount paid by the user to FlowMarket in the 12 months preceding the event giving rise to liability.

8. Governing Law

This limitation of liability clause is governed by French law. The limitations above apply to the extent permitted by applicable law and shall not affect mandatory rights granted to consumers.
